FARMINGTON POLO GROUNDS
RELEASE OF LIABILITY,
VOLUNTARY ASSUMPTION OF THE RISK,
HOLD
HARMLESS/INDEMNITY & WAIVER OF CLAIM AGREEMENT
This Release Of Liability,
Voluntary Assumption Of The Risk, Hold Harmless/Indemnity & Waiver Of Claim
Agreement (“Agreement”) is
entered into by and between _________________________________________ ________________________(“Participant”
organization or individual) and Bozzuto’s, Inc. and Town Farm Development LLC (jointly, dba as the “Farmington Polo Club”)
and Hometown Foundation, Inc. (together, referred to herein as, the “Farmington
Polo Grounds”).
Participant has decided to hold, host, sponsor, organize and/or
participate in the following event at property owned and managed by the
Farmington Polo Grounds at 152 Town Farm Road, Farmington, Connecticut (the
“Property”) voluntarily: ___________________________________________(name of
event) on _____________- ___________, 20__ (date(s) of Event). Participant is aware that there are equine activities at the Property continuously, and that these may include polo lessons, polo competitions,
purchase and sale activities, horse care and barn activities, and boarding and
pasturing horses. Participant recognizes that equine activities, and being around
horses generally, is hazardous and that the potential hazards include
the risk of serious injury, including serious bodily injury, including death,
and property damage. It is understood by Participant that horses, by nature,
can be unpredictable, that the risk of serious injury and other harm cannot be
eliminated. Participant acknowledges and accepts that it is Participant’s
obligation to manage and reduce risks by staying away from and instructing
those under its control, including volunteers, spectators and/or its
contractors and other agents, to stay away from all horses and equine
activities that are not part of the Event.
In consideration of being allowed to hold, host, sponsor, organize
and/or participate in the Event, Participant expressly and freely agrees to assume all risk, including risk of serious personal injury, death and other damages or losses, arising
from equine activities and to waive and release any and all claims arising from the Event, generally, and/or equine activities, due to any cause whatsoever, to the
fullest extent of the law, including claims of negligence that Participant may have
now or in the future against Farmington Polo Grounds, its officers, employees
or agents, and hold harmless and indemnify the Farmington Polo Grounds against any
and all claims arising from the acts or omissions of Participant and/or of Participant’s
volunteers, participants, employees,
spectators and guests.
FOR
ORGANIZATIONS:
I, the undersigned, represent
that I am duly authorized by ________________________________ (the “Participant “ organization) to accept
the terms set forth above and enter into this Agreement on behalf of the
organization. I represent that the organization is signing this agreement
freely and of its own accord with the understanding that it is binding upon the
organization as set forth above. On behalf of the organization, I agree that an
electronic, scanned version of this signed document shall serve as an original.

FOR
INDIVIDUALS:
